He claims 108,000 euros from the neighboring beach club because the children are making noise
Noise is a nuisance feared by an ever-growing number of French people. This recent owner of a house in Penvénan (Côtes d’Armor) located next to the “Club de plage des dunes” had estimated the damage caused to him by this neighborhood at 108,000 euros. As reported by the Actu.fr websiteit all started with the fact that the purchase was made in the summer of 2020, when the club, located on the Dunes beach as its name suggests, was relocated to the center of Roc’h Gwen , on a plot neighboring that of the buyer.
Believing that it had not been informed of this development and deploring the fact that the “direct and permanent vis-à-vis the club’s sports facilities” did not allow him “to use its terrace and open its windows”the owner took the case to the Administrative Court of reindeer. This noisy neighborhood would cause him a prejudice of “loss of valueof his property, which he estimates at 85,000 euros, not to mention 5,000 euros in non-pecuniary damage related to the handling of his case by the municipality and threats suffered on social networks and various other costs bringing the total to 108,000 euros.
A site that has welcomed children since 1960
The Rennes magistrates were not very sensitive to his arguments, considering that if the environment can be noisy, the situation “cannot be sufficient to characterize an abnormal and special disorder”. The discomfort is also limited to a few moments during the day and the club only welcomes children during the summer period for 7 weeks. The town hall of Penvénan has also argued that the current land of the beach club is “assigned since the 1960s to the reception of children”. Perfidious, she points out that the alleged impossibility of accessing her terrace of the plaintiff “seems to have an intolerance to noise”. Result: the dissatisfied owner was ordered to pay 2000 euros in legal costs to the municipality and has until June 13 to appeal this decision.
